DISTANCE AGREEMENT

This Distance Agreement (hereinafter – the Agreement) is concluded between:

The Seller:

and

The Buyer: A natural person who places an order in the online store (hereinafter – the Buyer).

The Agreement is concluded in accordance with:

  • Directive 2011/83/EU of the European Parliament and of the Council on consumer rights;

  • The Consumer Rights Protection Law of the Republic of Latvia (PTAL);

  • Cabinet Regulation No. 255 "Regulations Regarding Distance Contracts."

1. GENERAL PROVISIONS

1.1. This Agreement applies to all purchases made in the Seller's online store.

1.2. By placing an order, the Buyer confirms that they have read, understood, and agreed to the terms of the Agreement.

1.3. The Agreement is binding on both parties from the moment the order is confirmed.

2. ORDERING AND PAYMENT TERMS

2.1. The Buyer selects goods in the online store, adds them to the shopping cart, and completes the order form.

2.2. Before confirming the order, the Buyer is provided with the opportunity to check the entered information and correct any errors.

2.3. The Agreement is considered concluded at the moment the Buyer receives an electronic confirmation at the specified email address regarding the receipt of the order and the conclusion of the transaction.

2.4. Payment for goods is possible using:

  • Payment cards;

  • Payment upon receipt of the goods (at a parcel machine), if such an option is available.

2.5. All prices are indicated in euros (EUR) and include applicable taxes.

3. DELIVERY TERMS

3.1. Delivery of goods is provided by the Omniva parcel machine network. 3.2. Delivery is carried out in the following countries: Latvia, Lithuania, and Estonia.

3.3. Delivery costs in Latvia

  • Order value up to 100 EUR – 3.90 EUR

  • Order value from 100 EUR – Free of charge

  • Payment upon receipt at the parcel machine:

    • Up to 100 EUR – 6.80 EUR

    • Over 100 EUR – 2.90 EUR

3.4. Delivery costs in Estonia

  • Order value up to 100 EUR – 3.90 EUR

  • Order value from 100 EUR – Free of charge

  • Payment upon receipt at the parcel machine:

    • Up to 100 EUR – 8.80 EUR

    • Over 100 EUR – 4.90 EUR

3.5. Delivery costs in Lithuania

  • Order value up to 100 EUR – 3.90 EUR

  • Order value from 100 EUR – Free of charge

  • Payment upon receipt at the parcel machine:

    • Up to 100 EUR – 7.40 EUR

    • Over 100 EUR – 3.50 EUR

3.6. The delivery period shall not exceed 7 working days, unless otherwise specified in the product description or order confirmation.

4. RIGHT OF WITHDRAWAL AND RETURNS

4.1. The Buyer has the right to withdraw from the Agreement within 14 calendar days from the day of receipt of the goods without providing a reason.

4.2. To exercise the right of withdrawal, the Buyer must send a free-form notice to the email info@bergamo.lv, stating:

  • First name, last name;

  • Order number;

  • The withdrawal statement.

4.3. The Buyer must send the goods back to the Seller no later than 14 days after notifying the withdrawal.

4.4. The goods must be returned in the same manner they were delivered:

  • If the item was purchased in person at a store – the return must be made at the store;

  • If the item was received via a parcel machine – the return must be made using a parcel machine.

4.5. A return parcel machine code is generated and sent to the Buyer after the Seller has received the withdrawal application at info@bergamo.lv.

4.6. Return costs are covered by the Buyer unless the Seller has specified otherwise.

4.5. Hygiene Requirements

Since the goods traded are sunglasses, the right of withdrawal may not be applied if:

  • The item has been used;

  • The original packaging is damaged or removed;

  • The item does not comply with hygiene and safety requirements. In such cases, the Seller has the right to refuse to accept the item back in accordance with the provisions of Section 12, Paragraph six of the Consumer Rights Protection Law (PTAL).

5. REFUND TERMS

5.1. The Seller shall refund the amount paid by the Buyer within 14 days from the day the notice of withdrawal was received.

5.2. The refund is made using the same means of payment that the Buyer used for the initial transaction, unless otherwise agreed.

5.3. The Seller has the right to withhold the refund until the goods have been received back or the Buyer has provided proof of dispatch.

6. ORDER CANCELLATION

6.1. The Buyer can cancel the order if it has not yet been handed over for delivery by contacting the Seller via email at info@bergamo.lv.

6.2. If the order has already been handed over for delivery, the Buyer may exercise the right of withdrawal in accordance with Section 4 of this Agreement.

7. DISPUTE RESOLUTION

7.1. The parties shall attempt to resolve all disputes through mutual negotiations.

7.2. If a dispute cannot be resolved through negotiations, the Buyer has the right to contact:

  • The Consumer Rights Protection Centre (PTAC) (www.ptac.gov.lv);

  • Use the European Union Online Dispute Resolution (ODR) platform.

7.3. Disputes are resolved in accordance with the legislation of the Republic of Latvia.

8. FINAL PROVISIONS

8.1. The Seller reserves the right to amend the terms of the Agreement by publishing the current version in the online store.

8.2. This Agreement is governed by the laws and regulations of the Republic of Latvia.
